LEGAL NOTICE AND GENERAL CONDITIONS OF USE

 

Introduction

“ÁREAS, S.A.U. (hereinafter, “AREAS” or the “Company”) is a Spanish commercial company with its registered office at Av. Diagonal 579-587, 08014, Barcelona and with Corporate Tax Identification Number A-08225013. The company is registered in the Business Registry of Barcelona under Volume 43308, page 11, sheet number B-33570.
AREAS is the holder of the intellectual property rights as well as any other type of right over the portal accessible through the website es.areas-dev.com/ (hereinafter, the “Web Page”).
These terms and conditions (hereinafter, “TC”) establish the relationship between the user (hereinafter, the “User”) with the Company, and govern the access, browsing and use of the Web Page. Upon accessing the Web Page, the User accepts these TC. If the User does not agree with the terms and conditions, the User must refrain from accessing and using the Web Page. Purpose of the Web Page

The purpose of the Web Page is to provide general and commercial information about the Company. The information provided through the Web Page is for informational purposes and not exhaustive. Furthermore, this information may not be up to date at all times. Access to the Web Page is free of charge. However, the services offered through the Web Page may imply the usage of data. AREAS shall not be liable for the costs arising from the communication and delivery of data or the Internet connection that the Users may incur. Users may consult their telecommunications operators to obtain more information on this matter.

Intellectual and Industrial Property Rights

“its information, texts, data, marketing plans and other documents of an advertising nature, models, graphs, designs, software, images, photographs, voices, sounds, videos, multimedia content, distinguishing signs, brands and other content of the Web Page) are owned by AREAS and/or their licensors.
Except in the cases in which rights have been granted or said rights derive from the law, the only rights that the User acquires over the cited Intellectual and Industrial Property Rights are the rights that are strictly necessary to use the Web Page in accordance with these TC. Consequently, Users recognize and accept that the use of the Web Page does not involve the transfer to the User’s favor of any intellectual or industrial property right, such as copyrights, brands, designs or other rights of the web Page, nor does it constitute any authorization for the creation of developments derived from the Web Page and/or its elements, except for the limited use license which is granted to Users to use the Web Page in the terms established herein.
Furthermore, Users must abstain in all cases from deleting, altering, evading or manipulating any protection device or security systems that may be installed on the Web Page.”

Modifications of the GCU

AREAS reserves the right to modify or update these TC at any time. For that reason, the company will proceed to include the new version of the TC on the Web Page for the Users’ general knowledge.

Responsibilities

“The User uses the Web Page on their own behalf and at their own risk. By accessing the Web Page, the user is obligated to use it in accordance with the Law, being liable to AREAS and/or third parties for any damage or harm that may be caused as a consequence of not complying with this obligation. In this sense, AREAS shall not be held liable for any damage or alteration on the User’s devices as a result of the installation and use by the User’s part of the Web Page.
In any case, the User shall be fully liable for the data or content that it transmits or communicates to AREAS. AREAS does not control or supervise any of the cited content, unless the competent court or an administrative decision establishes as such. AREAS reserves the right to remove the content or prevent it from being viewed until the ownership of the material in question or the legality of the same is proven.
AREAS shall not be held liable for the possible security errors that may occur nor for the possible damages that may be caused to the User’s device (hardware and software) and/or to the files or documents stored therein as a consequence of the presence of a virus on the device that the User used for the connection to the services and content of the Web Page, Internet or telephone malfunctions, interference, omissions or disconnections in the operational functioning of the Web Page caused by reasons beyond the control of AREAS.
The Web Page can contain links to other websites and incorporate information and/or services obtained from third parties. AREAS does not exercise any control over the links, information and/or services and is not responsible for their content, operation or transmission received by third parties. AREAS offers users these links and information and/or services only for the User’s comfort, with the latter liable for reading and accepting the terms and conditions of use and privacy policies published on the linked websites or applications.

Independence and integration of the clauses

The illegality, invalidity, and ineffectiveness of any of the clauses in the TC will not affect the effectiveness of the rest, provided that the Parties’ rights and obligations under the TC were not affected in any substantial manner. Substantial is taken to mean any situation that severely damages the interests of either of the Parties or that affects these TC. These clauses should be replaced by or incorporated into others that, in compliance with the law, satisfy the purpose of those replaced.

Final provisions, applicable legislation, competent jurisdictional courts

“These TC are governed by common Spanish legislation. If Users have the condition of consumer, these TC will also be subject to the applicable local legislation.
Any controversy that may arise from the use of the Web Page or these TC will be submitted to the competent courts of the city of Barcelona (Spain), and in the case that the User acts as a consumer, to the court of the domicile to which the User/consumer is entitled.
In the case that they act as a consumer, Users can likewise submit any dispute arising from or related to the TC to an alternative dispute resolution (“ADR”) procedure. The list of ADR platforms available from the European Commission can be consulted on the following link:
